Property Listing Terms

These guidelines shall be incorporated into and made part of the Terms of Use of YAWD.Com; by YAWD.COM Real Estate
Unless we agree in writing to represent you, do not assume that we represent you. Even if we say or act (imply / implied) in any way as to represent you, our representation must be expressed in writing. We do not offer implied representation.
Unless otherwise agreed in writing; we are a facilitator and you are a customer.

In posting your real property (also refered to as listing, property, the singular or plural or combination) to YAWD.Com, you agree that it is in compliance with our guidelines as outlined herein and you accept agree to all terms.

You agree to electronic signature in accepting all agreements, disclosures, contracts, and any other documents that require your agreement and or acceptance. IF YOU DO NOT AGREE TO YOUR ELECTRONIC SIGNATURE, YOU CANNOT USE YAWD.COM.
You represent that you are an adult of adequate mental capacity and the legal owner or legally authorized person with written permission, to market or offer the property; for sale, rent, lease or exchange. We reserve the right to verify ownership of all properties LIsted on yawd.com. We may require verification of ownership or legal right to sell on any and all property listings. In order to prevent abuse and to keep this marketplace reputable and appropriate for our general audience.

By posting a new property here, you agree to the following statement:
    I understand and agree that all real estate listing(s) I post will be in accordance with Fair Housing Laws of State, Federal and other Domicile in which the real estate is located. I understand that I am required (depending on local Laws) to disclose to buyer(s); material facts, conditions, issues that may affect the buyer's decision in purchasing my property. I agree that I will be solely responsible for the content of all properties that I post on yawd.com and that I will indemnify YAWD.Com and hold them harmless or excluded for any losses, claims or damages to myself or to others that may result directly or indirectly from any properties that I post at yawd.com. I also grant to YAWD.Com the non-exclusive, rayalty free, world wide ownership rights to all contents and multimedia files posted, unless the content or files posted are legally owned by a third party, in which case I would not be transferring ownership rights.
    The USA Fair Housing Act or other similar Law of your property Country; prohibits discrimination in housing based on age, color, race, religion, national origin, sex, familial status, or disability. We are rquired to adhere to fair housing laws of which we take very seriously. By using the Fair Housing and Equal Opportunity (FHEO) logo on our web site, we show our full support for and our commitment for compliance with this law.
By posting a new property here, you further agree to the following terms:
  1. There is no agency representation offered or created - express or implied, without written agreement or written disclosure, in offering services to you.
  2. The compensation (commission) you offer is an express and binding offer that we accept to sell your property.
  3. You understand, agree and accept that: unless you have a written agreement to be represented by the real estate broker; you are not represented and you are responsible to protect your own interest, and that the broker is only providing ministerial acts in the transaction.
  4. You agree to maintain current information with us on your property listing(s).
  5. All real property listings (except land), requires at least one photo for varification, which should be uploaded with the newly posted property or email to us within 24 hours. There are NO exceptions, property listing without a photo will be deleted promptly.
  6. Once a listing has been posted and approved, you cannot delete it. You may only request to edit or delete a listing if there is inaccuracies or a violation of these terms or Fair Housing Laws.
  7. No foul or otherwise inappropriate, or offensive language should be included in property listing.
  8. No racist, hateful, or otherwise offensive comments should be included in property listing.
  9. No property promoting activities that would be illegal under the laws of the state or province, or the country of domicile of YAWD.Com shall be allowed. Similarly, no property promoting activities that would be illegal under the laws of the state or province, or the country of domicile of the person posting the property shall be allowed.
  10. No personal, explicit, nude, offensive, racist, discriminatory, photo should be uploaded to yawd.com, you may upload property photos only.
  11. Any property that appears to be merely a test posting, a joke, or otherwise insincere or unauthorized is subject to removal.
  12. YAWD.COM reserves the ultimate discretion, which properties, if any, are in violation of these guidelines terms.
  13. Upon posting a property listing, you automatically sign up to receive our email lewsletter, web site updates and special offers from YAWD.Com. At anytime you may opt out by notifying us.
